The Haryana Real Estate Regulatory Authority Gurugram, on Monday imposed a fine of ₹30 lakh on a developer for placing advertisements in national dailies a joint venture with Sumitomo Corporation, Japan, in Sector 36A without registration with the authority.
From the perusal of the record in the office of HARERA, it was found that no such project had been registered with the authority and by doing this; the developer had violated the provisions of Section 3(1) of the Real Estate (Regulations and Development) Act, 2016 which prohibited any advertisement before registration with the RERA.
Responding to the authority’s show cause notice in this regard, the developer in its reply on March 8 contended that the company had not solicited any sale or done any booking confirmation.
The authority, in its six-page order, said that “the respondent company failed to rebut the issues raised in the show cause notice” and imposed the fine. The order further said that proceedings under Section 59(2) of the Act should be initiated against the respondent company if it failed to deposit the fine with 15 days’ time.
